An Act to requisition the services of medical graduates

No. Legis. X-(20)/74.-The Baluchistan Medical Graduates (Compulsory Service) Bill, 1974, having been passed by the Provincial Assembly of Balu*chistan on 4th December 1974 and assented to by the Governor of Baluchistan is hereby published as an Act of the Provincial Assembly:-
Preamble.-Whereas it is expedient to secure the services of the Medical Grauduates for the Province of Baluchistan;
1. Short title, extent and commencement
(1) This Act may be called the Baluchistan Medical Graduates (Compulsory Service) Act, 1974.
(2) It shall come into force at once.
(3) It shall apply to the Province of Baluchistan except the Tribal Areas.
2. Definitions
In this Act, unless there is anything repugnant, in the subject or context-
(i) “Government” means the Government of Baluchistan.
(ii) “Medical Graduate” means a person who has graduated in the faculty of medicine and surgery or has undertaken any post-graduate or higher degree in medicine or surgery at the expense of the Government of Baluchistan or has studied in any other College or Institution against the reserved seats of the former Quetta and Kalat Divisions (now Baluchistan) or was nominated or may be nominated by the Government for studies abroad.
3. Requisitioning of Service
Notwithstanding anything contained in any other law, a Medical Graduate shall be liable to serve the Province of Baluchistan for a period of at least five years, if so required by Government,–
(a) if he has graduated on or after the first day of July 1970, but before the commencement of this Act, within one year of the date of commencement of this Act;
(b) if he graduates after the commencement of this Act, within one year of his graduation.
4. Offence and Penalty
Whoever disobeys the order of Government with respect to the requisitioning of his service or in any other manner defies the notice issued by the Government, shall suffer imprisonment for two years and shall also be liable to fine which may extend to ten thousand rupees.
5. Cognizance of offence
No Court shall take cognizance of an offence under this Act, except on complaint by the Government or an officer authorised in this behalf by the Government and on the recommendation of the Committee constituted by Government for the purpose.
6. Making of Rules
Without prejudice to the generality of the foregoing provisions the Government may make rules to carry out the provisions of this Act.
