No. PAB/LEGIS.V(8)/97, dated 14?11?1998.??The Balochistan Health Foundation (Amendment) Act, 1998 having been passed by the Provincial Assembly on 24th October, 1998 and assented to by the Governor of Balochistan is hereby published as an Act of the Provincial Assembly.
Preamble.?-Whereas, it is expedient to amend the Balochistan Health Foundation Act, 1994, in the manner hereinafter appearing;
It is hereby enacted as follows:?—-
1. Short title and commencement
(1) This Act may be called the Balochistan Health Foundation (Amendment) Act, 1998.
(2) It shall come into force at once
2. Amendment of section 2 of Act I of 1994
In the Balochistan Health Foundation Act, 1994, hereinafter referred to as the said Act, in section 2,
(a) for clause (q), the following shall be substituted
“(q) ‘Rural areas’ means areas declared by Government to be rural areas;
(b) after clause (q), the following new clauses shall be added:
“(r) ‘Urban Areas’ means areas declared by Government to be urban areas
(s) ‘Vice?Chairman’ means the Vice?Chairman of the Foundation”
3. Amendment of section 3 of Act I of 1994
In the said Act, after the proviso of subsection (1) of section 5, the following new subsection, shall be added:??
“(IA) The Vice?Chairman shall be designated amongst the members of the Board, who shall carry out all the duties and functions of the Chairman in his absence.”
4. Amendment of section 13 of Act I of 1994
In the said Act, for clause (b), (c), (d) and (e) of subsection (2) of section 13; the following shall be substituted:
‘(b) Give grants, to non profit making Health Institutions in rural and urban areas for purchase of Medicines, Land, Construction of Building, Purchase of Equipments, Furniture etc. not exceeding 1/3rd of total cost as grant, and 1/3rd as a Loan, while remaining cost shall be borne by the Organisation/Institutions;
Provided that grant?in?aid is not applied for the amount of the Loan applied/offered, can be up to 50% of the proposed Project/Scheme.
(c) Give loans to such Health Institutions working on commercial basis in rural and urban areas to the extent of 50 % of the total cost, whereas the remaining 50 % of the cost shall be borne by the Institution itself.
(d) Provide loans to Doctors for opening of Clinics in Rural and Urban Areas of the Province.
(e) Assist the Commercial/Non?Commercial Institutions and Doctors working in the Rural and Urban Areas. in getting loans from Scheduled Banks and Financial Institutions.
5. Amendment of section 19 of Act I of 1994
In the said Act, section 19, shall be renumbered as subsection (1) and thereafter the following new subsection (2), shall be?added:??
“(2) All dues and outstanding shall be recovered as arrears of Land Revenue”
