An Ordinance further to amend the Balochistan Civil Servants Act, 1974

No. Legis. 1-12/Law/73-II, dated 8-9-2000.–The following Ordinance made by the Governor of Balochistan on 5th September, 2000, is hereby published for general information:—-
Preamble.—–Whereas it is expedient further to amend the Civil Servants Act, 1974, for the purpose hereinafter appearing;
And whereas the Provincial Assembly of Balochistan stands suspended in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Governor of Balochistan is satisfied that circumstances exist which render it necessary to take immediate action;
Now, therefore, in pursuance of Article 4 of the Provisional Constitution (Amendment) Order, 1999 (Chief Executive’s Order No.9 of 1999), and in exercise of -all powers enabling him in that behalf, the Governor of Balochisten on the instructions of the Chief Executive of Pakistan, is pleased to make and promulgate the following Ordinance:– ,
1. Short title and commencement
(1) This Ordinance may be called the Balochistan Civil Servants (Amendment) Ordinance, 2000.
(2) It shall come into force at once.
2. Substitution of section 13 of Act IX of 1974
In the Balochistan .Civil Servants Act, 1974, for section 13, the following shall be substituted namely:–
” 13. Retirement from service.–(1) A civil servant shall retire from service— .
(i) On such date after he has completed twenty-five years of service qualifying for pension or other retirement benefits as the competent authority may, in public interest, direct, or
(ii) Where no direction is given under clause (i), on the completion of the sixtieth year of his age.
(2) No direction under clause (i) of subsection (1) shall be made until the civil servant has been informed in writing of the grounds on which it is proposed to make the direction, and has been given a reasonable opportunity of showing cause against the said direction.
Explanation.–In this section “competent authority” means the appointing authority prescribed in rule 4 of the Balochistan Civil Servants (Appointment, Promotion and Transfer) Rules, 1979.
